Like many contracts, we sign on the dotted line prior to reading the fine print. The ignition
interlock operator’s affidavit is no different. When you enter the Interlock Program in
 Massachusetts, you must complete an ignition interlock operator's affidavit (for reference: Click
Here). What you may not pay close attention to is the line items referencing what violations or
combinations of violations can lead you to be called in by the Registry of Motor Vehicles for a
hearing. In order to avoid being called in for a hearing, you need to be cognizant of what
constitutes a potential violation of the program. A violation may have nothing to do with positive
alcohol readings. The violations and combinations of violations that may get you called in for a
hearing are as follows:

  1. Operating a motor vehicle without an ignition interlock device.
  2. Soliciting or allowing any other person to blow into an ignition interlock device in an
    attempt to either start an ignition interlock device equipped vehicle or during a rolling re-
    test in an ignition interlock device equipped vehicle.
  3. Using any other means other than blowing a breath directly from your mouth into an
    ignition interlock device.
  4. Any attempt to tamper with or circumvent an ignition interlock device.
  5. A failed rolling re-test in which your BAC registered at or above .05 over the entire life
    of your ignition interlock device obligation.
  6. Two failed rolling re-tests within one service period in which your BAC registered
    between .02 and .05.
  7. Two lockouts due to missed rolling re-tests over the entire life of your ignition interlock
    device obligation.
  8. Two missed service visits over the entire life of your ignition interlock device obligation.
  9. Two lockouts due to failed start-up tests over the entire life of your ignition interlock
    device obligation.

If you have a violation or lockout, the Registry allows you to contest the validity of that violation
within 30 days of the date of the violation. After 30 days, your right to contest the violation is
