If you received a letter from the Massachusetts Registry of Motor Vehicles with language stating you are suspended for a Complaint Fraudulent License, you will want to seek out legal representation.
Although in most of these cases, there are no corresponding criminal charges, the Massachusetts RMV can still take further action against your driver's license. This type of suspension alleges that you were found to have used false information and/or documentation to obtain a driver's license or were caught using fraudulent identification.
The uptick in fraudulent license suspension cases is due in part to the Registry's use of sophisticated facial recognition software. If they have identified your facial features on one or more accounts with mismatched information, they will likely call you in for a hearing. The Registry of Motor Vehicle's Enforcement Services department is responsible for holding hearings related to these matters. The primary purpose of the hearing is to establish your actual identity. The secondary purpose is to impose a suspension period if the hearing officer finds that fraudulent documents were used. These hearings are discretionary, meaning that the hearing officer will have the authority to suspend your license for some time or allow you to reinstate it.
We have had significant success helping clients through this process. Our goal is to avoid suspension entirely or limit the suspension length to 60 days. In the event a suspension length of 180 days is imposed, we have taken clients to the Division of Insurance Board of Appeals, and they have issued an order granting clients their license.
